Fresno City Council Faces Recusal Debate Over $40 Million Costco Project

The Fresno City Council is set to deliberate on a significant development project involving a new Costco in north Fresno, with a potential $40 million fee exemption on the line. However, the proceedings are complicated by calls for Councilmember Mike Karbassi to recuse himself due to alleged bias.

Recusal Request

The Herndon-Riverside Coalition for Responsible Planning and Development has formally requested that Karbassi step aside from the vote. This follows his comments labeling project opponents as “professional environmental agitators” and “haters” in a GVWire interview and a recent budget meeting. The coalition’s attorney, Daniel Brannick, argues that these statements demonstrate an unacceptable probability of bias, which could violate due process in what is considered a quasi-judicial decision.

Legal and Financial Implications

The council’s decision on the Costco project involves applying existing zoning rules, making it a quasi-judicial vote where impartiality is required. The project, which includes a mini-warehouse, is poised to benefit from a $40 million exemption under Fresno’s vehicle-miles-traveled (VMT) mitigation program. This exemption is based on a grandfather clause, as argued by Costco’s attorneys, but Brannick disputes this interpretation, citing environmental impact considerations under CEQA.

The financial stakes are high, with the $40 million exemption surpassing two years of Measure C funding allocated for public transit in Fresno. Councilmember Miguel Arias expressed concern over the lack of analysis provided to the council regarding the financial impact of the exemption.

Upcoming Decision

The council is scheduled to address the project at City Hall on Thursday morning. As the debate over potential bias and financial implications continues, the outcome could have lasting effects on Fresno’s development landscape and legal precedents for councilmember conduct in quasi-judicial decisions.
