Texas Tech’s Brendan Sorsby Granted Injunction to Play Despite NCAA Gambling Ban

In a significant development for Texas Tech football, quarterback Brendan Sorsby has been granted a temporary injunction against the NCAA, potentially allowing him to play this fall. The decision comes after Sorsby was declared ineligible due to his involvement in gambling on college sports, including bets on his own team while at Indiana.

Legal Proceedings and Conditions

The ruling was issued by Judge Ken Curry in Lubbock County, home to Texas Tech. It prevents the NCAA from blocking Sorsby’s eligibility during ongoing legal proceedings. However, Sorsby will miss the first two games of the season, a penalty proposed by his legal team. The NCAA has the option to appeal the decision, though no immediate plans have been announced.

As part of the injunction, Sorsby must continue individual clinical counseling for his gambling issues and participate in peer support groups like Gamblers Anonymous. He is also required to address underlying anxiety contributing to his gambling behavior. Texas Tech’s athletic director, Kirby Hocutt, emphasized the university’s commitment to supporting Sorsby’s recovery and compliance with the court’s order.

NCAA’s Concerns and Response

The NCAA expressed strong disagreement with the court’s ruling, citing concerns about the potential impact on the integrity of college sports. NCAA attorney Taylor Askew argued that allowing Sorsby to play without punishment could harm the organization’s reputation and set a precedent for leniency in gambling cases.

Court records indicate that Sorsby placed thousands of bets totaling at least $90,000 during his time at Indiana, Cincinnati, and Texas Tech. Although NCAA rules typically call for permanent ineligibility for players betting on their own teams, Sorsby did not bet on games in which he participated.

Background and Future Implications

The NCAA investigation began after a tip from an online gambling book, which was informed by law enforcement. Sorsby, who has a diagnosed gambling addiction and anxiety-driven compulsion, recently completed a residential treatment program in Arizona. His attorney, Jeffrey Kessler, argued that preventing Sorsby from playing could negatively affect his mental health and recovery.

The legal battle began with a lawsuit filed by Sorsby on May 18, seeking to restore his eligibility. The NCAA has twice denied Texas Tech’s petitions to reinstate him, prompting the university to pursue legal action. With the season opener against Abilene Christian approaching, the outcome of any NCAA appeal remains uncertain.
