Sheridan County Commissioners Appoint Engineer Ken Muller as Viewer for Lodore Alley Vacation

At the most recent meeting of the Sheridan County Commission, commissioners considered a request to vacate a portion of an alley in the Town of Lodore. The alley in question runs along the north side of Lots 13 and 14 in Block 3 and Lots 13 and 14 in Block 4. After discussion, the commission voted to appoint County Engineer Ken Muller as the viewer for the proposed vacation.

Viewer responsibilities outlined

The appointment follows the standard “Oath of Viewer” process used by the county for land‑vacation matters. Under that oath, Mr. Muller will evaluate several key factors:

  • Whether the alley is required for public use or can be deemed unnecessary.
  • The convenience and expense to both the public and private owners of maintaining the alley.
  • If the vacation is practical, or if the alley should remain in place.
  • The probable cost of vacating the alley, including any damages to adjacent property owners or potential benefits they may receive.

In addition to these assessments, Mr. Muller is required to compile a written report summarizing his findings and recommendations. That report will be submitted to the county commission for final review and action.

Why the vacation matters to Lodore residents

Vacating an alley can affect property owners in several ways. If the alley is deemed unnecessary, owners may see reduced maintenance obligations and possibly lower property taxes related to public right‑of‑way upkeep. Conversely, the loss of a public thoroughfare could impact access for emergency services or alter traffic patterns. The commission’s decision to appoint a qualified engineer reflects a commitment to a thorough, fact‑based analysis before any change is made.

Next steps

After the viewer’s report is delivered, the commission will hold another public meeting to consider the findings. Should the commission approve the vacation, a formal ordinance will be drafted and recorded, officially removing the alley from the public right‑of‑way. If the report recommends retaining the alley, the commission will maintain the status quo.

Residents of Lodore and surrounding areas are encouraged to attend the upcoming meeting where the report will be discussed. Public input is a vital part of the process, ensuring that any decision reflects both the practical needs of the community and the stewardship of taxpayer resources.
