Florida Execution Set For William Silvia

Florida is scheduled to execute 61-year-old William Frances Silvia on Tuesday, August 18, at 6 p.m. ET at Florida State Prison in Raiford. Silvia was condemned for the 2006 murder of his estranged wife, Patricia Silvia, in Seminole County, following an 11-1 jury recommendation for the death penalty.

Advocacy Group Calls for Stay of Execution

The advocacy group Floridians for Alternatives to the Death Penalty (FADP) has called for a stay of execution and requested that Silvia’s sentence be commuted to life imprisonment without the possibility of parole, which serves as the sole alternative sentence for first-degree murder under state law.

FADP has announced plans to hold a peaceful vigil outside Florida State Prison beginning at 5 p.m. on the day of the execution, alongside additional vigils in Pinellas County, the Jacksonville area, North Port, Tallahassee, and other parts of the state.

Case records detail that Silvia has a documented background involving delusional thinking, paranoia, childhood trauma, alcohol dependence, and multiple head injuries, including a car crash that knocked him unconscious and an assault resulting in facial fractures. In the months leading up to the 2006 murder, Silvia became homeless and lost his employment.

At his trial, both prosecution and defense experts agreed that his chronic psychological disorders and paranoia served as mitigating factors.

Legal Proceedings

In 2012, Silvia waived his initial state postconviction proceedings, voluntarily dropping his right to challenge the death sentence. A trial court later granted him a new penalty phase after the U.S. Supreme Court struck down Florida’s capital sentencing scheme in Hurst v. Florida.

However, the Florida Supreme Court overturned that decision, ruling that Silvia’s prior 2012 waiver barred him from receiving relief under the new constitutional standard.

According to research from Cornell Law School Professor John Blume, 88 percent of the 106 capital defendants studied who waived their legal reviews had documented mental illnesses or severe substance abuse disorders, with at least 30 having prior suicide attempts.

“Serious mental illness shaped William Silvia’s life, the crime and the legal decisions that followed,” said Maria DeLiberato, Legal and Policy Director of FADP. “When the consequence is execution, a decision made in the throes of his mental illness should not permanently close the courthouse door to a constitutional protection recognized years later.”

Silvia remains held at Florida State Prison ahead of the scheduled Tuesday execution.
