Warren County trial: Defense says graphic texts are fantasies, not evidence

Warren County, Ohio – During a hearing on the ongoing criminal case against Erica Grove, the defense team contended that the graphic text messages presented by prosecutors are not factual evidence but imagined fantasies. Grove, a local resident, faces charges of drugging and sexually abusing a five‑year‑old child. Her boyfriend, Tony McCollister, who exchanged the messages with her, is also charged and awaiting trial.

Defense strategy focuses on text messages

Attorney Charlie Rittgers highlighted several excerpts from the couple’s messages, including one in which Grove allegedly wrote that she “drugged her dad and tried to molest him.” Rittgers asked a detective present in court, “She says she feels bad that she drugged her dad and tried to molest him, right?” The detective affirmed, “Correct.” The defense maintains that this exchange never occurred in reality and is intended to illustrate that some of the couple’s communications are purely fictional.

Rittgers also pointed to messages that describe sexual acts with animals, portraying McCollister as controlling and threatening. “They’re going to take pictures with the dogs, and if she ever lies to him, they’ll be exposed, true?” Rittgers asked, receiving another confirmation from the detective. The defense argues these statements further support the claim that the texts are fantasies rather than factual admissions.

Forensic and counseling testimony

Beyond the disputed messages, the prosecution presented forensic evidence. Dr. Samuel Kleinman, a forensic toxicologist, testified that hair samples taken from the child showed no indication of drug exposure. When Judge Robert Peeler inquired, “Is there anything that gives you a suspicion whatsoever that there were drugs in this child’s system?” Dr. Kleinman responded, “No.”

A child counselor, Dalenea Giusti, described the alleged victim’s behavior in court. Giusti noted that the child is usually talkative but becomes unresponsive when asked sensitive questions, displaying a flat affect and appearing “completely gone” when deeper topics about bodily contact are raised.

Next steps in the trial

The prosecution is expected to call Tony McCollister to the stand the following morning. Prosecutors may rest their case by the end of that day, after which the defense will have an opportunity to present its own witnesses and arguments.

The case continues to draw community attention in Warren County, highlighting concerns about child protection, the reliability of digital evidence, and the role of forensic testing in criminal proceedings.
