TikTok agrees to $400 million settlement with Justice Department over children’s privacy

The Justice Department disclosed Friday that TikTok will pay $400 million to resolve a federal lawsuit alleging the video‑sharing platform breached children’s privacy protections. Under the agreement, $300 million is payable immediately, with an additional $100 million to be released once a court vacates a prior consent decree that applied to TikTok’s predecessor, Musical.ly.

Federal lawsuit and parental‑consent requirements

The 2024 lawsuit claimed TikTok and its China‑based parent, ByteDance, failed to obtain parental consent before collecting personal information from users under age 13, a requirement of the Children’s Online Privacy Protection Act (COPPA). The complaint also asserted the companies ignored parental requests to delete children’s accounts, even when they knew the accounts belonged to minors.

Government response

U.S. Associate Attorney General Stanley E. Woodward Jr. called the settlement “a major victory for American children and parents,” emphasizing the Department’s commitment to enforcing online privacy laws and ensuring companies meet their legal obligations. The settlement is intended to provide a “substantial recovery” for families and reinforce the protections they expect.

TikTok’s recent corporate changes

Since the DOJ’s filing, TikTok has restructured its U.S. operations. In January, the company entered a joint‑venture arrangement with major investors—including Oracle, private‑equity firm Silver Lake, and the Emirati investment group MGX—to create a new U.S. entity. Representatives for TikTok did not respond to requests for comment on the settlement.

Broader context of social‑media privacy battles

The TikTok settlement arrives amid a wave of litigation targeting social‑media firms over children’s safety and privacy. Meta Platforms, the parent of Instagram, is currently on trial in federal court in Oakland, California, facing similar COPPA allegations. Internationally, several countries are moving to restrict or ban minors from accessing social‑media apps.

What the settlement means for families

While the monetary payment does not directly change TikTok’s data‑collection practices, the agreement signals heightened federal scrutiny of how tech companies handle minors’ information. Parents and guardians are reminded to review privacy settings, monitor app usage, and exercise their right to request account deletions when appropriate.

The pending $100 million portion of the deal hinges on a court order that would lift an earlier consent decree against Musical.ly. If that order is granted, TikTok will fulfill the full settlement amount, concluding the DOJ’s multi‑year enforcement effort.
