Texas GOP Files Federal Suit to Require Hand Count of Every Precinct Ballot

As Texans prepare to cast their votes on Tuesday, a Texas Republican organization has taken legal action to ensure that every paper ballot is manually counted before the results of the November 3 federal election are certified. The lawsuit, filed by the Potter County Republican Party and its chairman, Daniel Rogers, seeks a court order requiring election officials to compare human‑readable paper ballots with electronic totals and correct any discrepancies.

What the complaint asks for

The 27‑page complaint, lodged on October 27 in the Northern District of Texas, names Potter County Elections Administrator Christy Benge as the representative of a statewide class of county election administrators. The plaintiffs request that judges prohibit certain certification duties until the manual verification is complete, effectively mandating a full hand count of every precinct’s paper ballots.

Why the Republicans are pushing for a full audit

The complaint warns that voting systems that rely on machine‑readable barcodes or QR codes could be vulnerable to software glitches, supply‑chain weaknesses, or interference involving artificial intelligence. It cites federal intelligence assessments and Department of Homeland Security correspondence to underscore the seriousness of these potential threats.

They are not alleging past fraud

Importantly, the plaintiffs expressly state that they do not allege altered or inaccurately reported results in prior Potter County elections. They also clarify that they do not seek to postpone Election Day, cancel lawful ballots, or replace voting equipment before November 3.

Existing audit rules vs. the proposed statewide count

Texas law already requires post‑election hand‑count audits under Election Code Section 127.201. The secretary of state’s guide explains that officials typically audit at least three election‑day polling locations and three early‑voting locations, or 1 % of each category, whichever is greater, along with a comparable sample of mail‑ballot precincts. While this sample‑based system provides a level of verification, the plaintiffs argue it falls short of the comprehensive statewide count they are requesting.

Intervention by Democratic groups

The Democratic Senatorial Campaign Committee and Democratic Congressional Campaign Committee moved to intervene as defendants on October 29. The NAACP Texas State Conference, League of Women Voters of Texas, MOVE Texas Civic Fund, and Common Cause followed on October 30, arguing that imposing an unprecedented manual‑count requirement just before the election could cause delays and mistakes in counting millions of votes.

Court timeline

U.S. District Judge Matthew Kacsmaryk set November 4 at 5 p.m. CST as the deadline for a response from the plaintiffs and November 9 at 5 p.m. CST for replies from intervenors. As of the latest docket update on November 1, no injunction requiring a statewide hand count has been issued.

Current status

More than 7.7 million early ballots have already been recorded, according to a Dallas Express preview published on November 2. For now, Texas’s existing election procedures remain in place, and the request for a full statewide hand count remains a proposal pending federal court review.

What voters should know

Texans heading to the polls should be aware that the current system includes sample‑based hand‑count audits, which many election officials consider sufficient to verify results. The lawsuit reflects a broader national conversation about election security, and the outcome of this case could influence how future elections are administered in the Lone Star State.
