Supreme Court decision clears path for Trump administration’s mail‑voting rules

The Supreme Court’s latest opinion gives the Trump administration a green light to advance its mail‑voting integrity plan. Former White House deputy counsel Gene Hamilton told Fox News Digital that the decision means federal agencies such as the Postal Service, the Department of Homeland Security (DHS) and the Department of Justice (DOJ) can now begin implementing key components of President Trump’s order.

In a largely favorable ruling for the White House, the Court rejected a challenge brought by 23 states and the District of Columbia that argued the order would cause immediate harm. The majority held that states could not obtain an injunction based on speculative future injury because no concrete federal action had yet occurred.

The order directs the United States Postal Service to adopt standardized ballot envelopes and unique tracking barcodes, and to require states to use a federal portal for identifying voters who receive mailed federal ballots. DHS is tasked with compiling and providing states with lists of adult U.S. citizens, while the DOJ has been instructed to prioritize investigations and potential prosecutions involving ballots cast by ineligible voters.

Hamilton emphasized that any state seeking to block these measures must demonstrate a concrete or imminent injury, not merely a prediction of future harm. He warned that if courts later find the agencies overstep, the administration will “have a field day across the country” defending its policies.

State reactions

Attorney generals from several states immediately condemned the decision. California’s Attorney General Rob Bonta, who led the multi‑state lawsuit, called the ruling a “serious legal error” that lets the administration pursue an unconstitutional attempt to restrict mail voting. Arizona Attorney General Kris Mayes responded, “Over my dead body is that rule going to go into effect. We are going to fight this tooth and nail in the courts.” Pennsylvania’s Attorney General Josh Shapiro, a potential 2028 presidential candidate, warned that the administration does not run elections in any state.

Implementation timeline and pending litigation

While the White House has not provided specific dates for when the new rules will take effect, the Postal Service indicated it will not enforce the ballot‑mail rule for the upcoming midterm elections until the litigation is resolved. A separate injunction obtained by the League of Women Voters currently blocks the USPS from implementing the rule.

Hamilton predicts further legal battles as agencies move forward, noting that “there will be a lot more fighting to come.” The White House spokeswoman Lauren Bis reiterated the administration’s commitment, stating, “These are commonsense measures that protect the security of mail‑in ballots and ensure only Americans are electing American leaders.”

If the administration’s standards are adopted, voters could see more uniform ballot envelopes, barcode tracking, and a federal verification portal for mail‑in ballots.
