Neighbor’s warning shot turns deadly after altercation in NE El Paso

EL PASO, Texas – A routine call about a fight on the 10300 block of Windsor Drive turned into a violent shooting on Sept. 2, just blocks from Andress High School. Officers from the El Paso Police Department (EPPD) responded to a “fight‑in‑progress” report that quickly became a “shot‑fired” incident.

What happened

When officers arrived, they found a 49‑year‑old male with a gunshot wound to the abdomen. He was airlifted to University Medical Center for emergency surgery, where doctors treated injuries to his liver, stomach and colon.

According to court documents, the shooter was identified as Richard Montoya, a 49‑year‑old homeowner who said he heard a noise outside his house, grabbed his firearm and stepped onto his porch. Montoya reported that he saw his neighbor – the victim – engaged in a physical altercation with another nearby resident.

Montoya’s wife was on the street, speaking with 911, when Montoya moved closer to her. He told the victim to leave, warning him that his gun was not a toy. The victim allegedly began walking toward Montoya and his wife, prompting Montoya to fire a warning shot into the air. The victim continued forward, and Montoya fired a second round that struck the victim in the abdomen.

Police investigation

EPPD’s Crimes Against Persons unit took Montoya and several others to headquarters for interviews. The documents indicate Montoya claimed he was protecting his wife and himself, noting he had recent back surgery and could not defend himself physically.

The investigation remains ongoing. No arrests have been reported at this time, and authorities have not released any further details about potential charges.

Community impact

Neighbors expressed shock at the rapid escalation from a verbal dispute to a lethal encounter. The incident underscores concerns about gun safety and the importance of de‑escalation in residential areas. Local leaders have urged residents to report conflicts early and to seek non‑violent resolutions.

El Paso officials continue to monitor the situation and will provide updates as the case proceeds through the courts.
