The Department of Justice initially resisted the Heritage Foundation’s 2024 request for these records, citing exemptions under the Freedom of Information Act. However, the department reversed its stance following the inauguration of President Donald Trump, agreeing to release the records in response to the committee’s request. Biden’s lawsuit argues that this request is merely a pretext to bypass federal laws that would otherwise prevent the release of such materials.

Legal Proceedings and Implications

Biden’s lawsuit, filed in a federal court in Washington D.C., seeks to have the court declare the committee’s request invalid and to permanently bar the release of the records to both the committee and the Heritage Foundation. Earlier this month, Biden attempted to intervene in the Heritage Foundation’s ongoing lawsuit against the Justice Department regarding these materials. A judge has allowed Biden to join the case but has restricted him from making claims about the committee’s request.
