Democratic primary winner Katherine Waldron faces residency lawsuit in Palm Beach County District 6

Palm Beach County – In a dispute that could reshape the Democratic ticket for District 6, candidate Rudy Tinker has taken legal action to overturn the primary victory of Katherine Waldron. Tinker, who earned 33% of the vote compared with Waldron’s 53%, argues that Waldron did not meet the residency requirement at the time she filed her candidacy.

Legal filing details

Tinker’s lawsuit asks a judge to declare him the Democratic nominee and to prevent the county from certifying Waldron’s win while the case proceeds. The complaint points to a series of address changes recorded in public documents. According to the filing, Waldron listed a West Palm Beach address on Sapodilla Avenue when she initially filed in May. On June 1, seven days before the qualifying period began, she changed her voter registration to 11863 Wimbledon Circle, Unit 447, in Wellington, the heart of District 6.

Timeline and residency claim

Records show an MLS listing marked the Wellington studio as “Rented” on June 7. The following day, June 8, qualifying opened, and Waldron signed her oath stating the Wimbledon address as her “Address of Legal Residence.” Palm Beach County law requires candidates to reside in the district at the time of qualifying. Waldron maintains the timeline proves she satisfied that requirement, stating, “I established my residence in District 6 before the qualifying period and met the residency requirement when I qualified for office.”

Broader allegations

Tinker contends the address changes are part of a pattern, noting previous filings for other offices that also involved shifts in residence. He told WPBF investigative reporter Terri Parker, “You look at our history in that complaint and even her historical record of running either the port or state rep or this current District 6, they were all strategic moves.”

Property ownership and rebuttal

County property records indicate Waldron also owns a home on Gator Trail in West Palm Beach, outside District 6, which she reports as a rental. The lawsuit notes ownership alone does not prove where she lived when she qualified. Waldron rejected Tinker’s characterization, saying, “I do, in fact, live in the district and I have proudly represented this community for many years in the State House and on the Port of Palm Beach Commission. He has zero basis for stating otherwise.”

Next steps

Tinker is seeking an expedited hearing and emergency relief to halt certification of Waldron’s primary win pending a court decision. The case has been assigned to a judge, and WPBF 25 News Investigates will continue to follow developments.
