Companies Settle for $4M Over Yucaipa Gender Reveal Fire

In a significant legal development, three companies have agreed to pay more than $4 million to the United States following a devastating wildfire ignited during a gender reveal party in Yucaipa, California. The El Dorado Fire, which occurred on September 5, 2020, was sparked by a pyrotechnic smoke device set off in a field at El Dorado Ranch Park. This incident led to the destruction of 22,744 acres, damaged or destroyed two dozen structures, and tragically resulted in the death of a firefighter.

Legal and Financial Repercussions

The companies involved include Ohio-based Wholesale Fireworks Corp., its subsidiary American Fireworks Wholesale LLC, and Florida-based Pink or Blue Gender Team Inc. These companies faced allegations from the U.S. Forest Service for their roles in distributing, marketing, and importing the smoke bomb responsible for the fire. The lawsuit claimed that the companies failed to safely design and label the smoke bombs and did not adequately warn customers about the fire risks, despite being aware of the dangers. Notably, these smoke bombs were illegal in California.

As part of the settlement, Wholesale and AFW agreed to pay $4 million, while Pink or Blue agreed to a $50,000 payment. These funds are intended to recover costs incurred by the Forest Service and address damages to federal land. The couple who organized the gender reveal party also faced legal consequences, pleading guilty to criminal charges and being ordered to pay nearly $1.8 million in restitution.

Impact of the El Dorado Fire

The El Dorado Fire was one of many during a record-breaking wildfire season in California, which saw more than 4% of the state burned, nearly 10,500 buildings destroyed, and 33 lives lost. The fire injured 13 people and forced the evacuation of hundreds of residents in small communities within the San Bernardino National Forest area. It was finally contained on November 16, 2020, after blackening nearly 36 square miles of land across San Bernardino and Riverside counties.
