A state appeals court in Wisconsin has overturned Sister Bay’s short-term rental policy, which was challenged by several homeowners. The policy, adopted in 2022, limited rentals to using only four bedrooms. Several property owners sued, challenging that limit.

Appeals Court Decision

In an 18-page decision, the appeals court said the law allows homeowners to rent their entire homes, making the ordinance void. The court stated that the four-bedroom limit is in logical conflict with the plain language of Wisconsin’s ‘Right to Rent’ law.

Sister Bay could appeal the ruling to the Wisconsin Supreme Court. The appeals court’s decision reverses the circuit court’s grant of summary judgment in favor of the village and remands for the circuit court to issue a revised judgment declaring that provision preempted and therefore void.
