Waymo is appealing a preliminary injunction that prevents overnight operations at two recharging stations in Santa Monica. The injunction was issued by Santa Monica Superior Court Judge Bradley S. Phillips, who found that the stations are public nuisances due to noise, lights, and traffic.

The city of Santa Monica had sought the injunction, citing complaints from residents about noise and disruptions caused by Waymo lot workers and vehicles. Waymo had attempted to mitigate the issues by hiring more staff, implementing software updates to reduce noise levels, and installing light and noise barriers.

However, the judge found that these efforts were not sufficient to eliminate the public nuisance. The injunction prevents Waymo from operating the recharging stations between 11 p.m. and 6 a.m. pending trial.

Waymo has filed a notice of appeal, which will be heard by a three-justice panel of the Second District Court of Appeal. The company denies that a public nuisance existed and contends that the city’s allegations are unfounded.
