Warren County judge weighs graphic texts and lack of photos in child abuse case

A packed Warren County courtroom heard closing arguments in the trial of Erica Grove, who faces a dozen charges including rape, gross sexual imposition, child endangering and drug‑related offenses. Spectators wore pink ribbons to show support for the five‑year‑old victim at the center of the case.

Prosecutors present graphic texts as evidence

Assistant prosecutor Julie Kraft told the court that the thousands of text messages exchanged between Grove and her boyfriend, Tony McCollister, depict a “depraved, morally twisted” pattern of grooming and sexual abuse. The messages, according to the state, discuss explicit sexual acts, including bestiality, and reference a prior guilty plea by Grove for similar conduct.

Kraft argued that the defense’s claim the texts are merely fantasies ignores the consistency of the messages with other evidence, such as a photo showing Grove naked and covered in child‑like drawings that was shared in a thread discussing drugging the child and drawing on each other during a bath.

Defense challenges the reality of the texts

Grove’s attorney, Charlie Rittgers, countered that investigators have found no photographs or video recordings of the alleged abuse. He emphasized that one of McCollister’s 2024 messages to Grove read, “Lying is required. I want you to make up fake things you’ve done,” suggesting the texts were fabricated fantasies rather than factual accounts.

Rittgers also pointed out that Grove’s boyfriend owned multiple devices that allegedly recorded the exchanges. “If these things were actually happening, there would be photographs and pictures of them,” he said, urging the judge to focus on the lack of concrete visual evidence.

Judge’s next steps

Judge Robert Peeler indicated that he will issue his verdicts at a later date in open court, after weighing both the graphic textual evidence and the defense’s arguments about the absence of photographic proof.

The case underscores the community’s concern for child safety and the challenges courts face when evaluating digital evidence in sexual‑abuse prosecutions. Local residents expressed disgust at the alleged conduct, and many continue to rally around the victim, hoping for a resolution that upholds justice and protects vulnerable children.
