University of Pennsylvania professor urges Democrats to demand Supreme Court expansion

University of Pennsylvania climate science vice provost Michael Mann has entered the national political debate, urging Democratic candidates to adopt a clear stance on expanding the Supreme Court. In a recent podcast interview, Mann said a “litmus test” should require any Democrat seeking office to promise to add seats to the Court, framing the issue as a prerequisite for advancing major environmental reforms.

Litmus test proposal

“When it comes to Senate races, there should be a litmus test,” Mann told host Peter Dominick. “It isn’t just good enough to be a Democrat. You’ve got to be a Democrat who would be willing to expand the Supreme Court… If you care about the environment, you’ve got to vote for the Democrats now.”

Broader partisan context

Mann’s comments echo a growing chorus of Democratic leaders, including Sen. Elizabeth Warren and former Vice President Kamala Harris, who have publicly supported adding seats to the nation’s highest court. Proponents argue that a larger bench would enable the Court to address what they see as an outdated composition that blocks progressive policies on climate, wealth taxes, reparations, and other reforms.

Critics, however, warn that expanding the Court would undermine the constitutional principle of an independent judiciary. They contend that a partisan‑filled bench would erode the Court’s role as a counter‑majoritarian safeguard for minority viewpoints.

Legal background

The discussion also touches on recent Supreme Court decisions affecting agency authority. In 2024, the Court overturned the Chevron Doctrine in Loper Bright Enterprises v. Raimondo, restoring traditional judicial review of agency actions. Mann cited the decision to argue that a packed Court could more readily uphold aggressive climate regulations.

Past legal disputes

Mann’s own legal history includes a defamation case in which he was awarded nominal damages but faced a $1 million punitive award that was later reduced by a D.C. Superior Court judge. The court found Mann’s legal team had presented inflated figures regarding a lost research grant, resulting in sanctions and a reversal of the original verdict.

Implications for voters

By tying Democratic candidacies to a court‑packing pledge, Mann and like‑minded activists aim to pressure the party’s base and shape the upcoming election cycle. The proposal raises questions about how voters will weigh constitutional concerns against policy goals, especially as the nation approaches the 2026 midterm elections.

For now, the debate remains a flashpoint in the broader partisan struggle over the future of the Supreme Court and the direction of federal climate policy.
