A court hearing in Montgomery County Circuit Court will decide if a lawsuit challenging Republican gubernatorial nominee Tommy Tuberville’s residency in Alabama will continue. The lawsuit, filed by Brooke Lynn Dorgan and Justin Jude LeBlanc, claims Tuberville has not lived in Alabama for the required seven years as stated in the state constitution and is actually a resident of Florida.
Tuberville’s Response
Tuberville says he has the proof he needs to show he has lived in Alabama for the required time. In an interview, he listed the documentation he possesses as proof of his legal residence in Alabama, including his and his wife’s drivers’ licenses and tax payments for eight years in a row.
The plaintiffs, who identify themselves as military veterans, claim Tuberville has not met the residency requirement. Today’s hearing will decide if the lawsuit will progress to an expedited discovery phase, which would require Tuberville to turn over personal records to prove when he relocated back to Alabama.
Tuberville’s camp argues that the judiciary lacks jurisdiction, asserting that candidate qualifications represent political questions legally reserved for the political parties, the voters, and ultimately the state legislature.
