Texas Comptroller Don Huffines Faces Questions Over Undisclosed Venture Role

Dallas, Texas – Texas Comptroller Don Huffines, who has been serving in the interim role since July, has come under scrutiny for failing to disclose his position as president of Huffines Enterprises Science & Technology (HEST), a private‑equity firm that lists SpaceX among its portfolio companies. The omission appears on the personal financial disclosure form he filed in February, a document that state law requires candidates and elected officials to complete.

What the disclosure rules require

Texas law mandates that candidates and officeholders detail any executive roles they hold in businesses, regardless of whether they receive compensation. A 2023 legislative proposal to limit disclosures to compensated positions failed to pass, leaving the broader requirement in place.

Huffines’ business connections

HEST, founded in 2022, is linked to the Huffines real‑estate empire created by Don and his twin brother Phillip. The firm’s website previously listed Don Huffines as president and his son Russell as vice president. A September filing for HEST, LLC, signed after Huffines assumed the comptroller’s office, named him and his son Colin as managers. The website page that identified him as president was taken down in March, shortly after his financial statement was submitted.

Administration’s response

Huffines’ campaign spokesperson and senior adviser Allen Blakemore said the comptroller “holds no personal ownership interest in HEST or SpaceX, and has received no income from either entity.” Blakemore added that all SpaceX‑related incentives were approved before Huffines took office and that, since assuming the role, he has not approved, directed, or influenced any incentive, grant, or agreement involving entities in which he has a financial connection.

Critics and ethics experts weigh in

Political lawyer Andy Cates, an ethics specialist, argued that the timing of the SpaceX agreements is “irrelevant” to the disclosure requirement. “Being manager of a family firm is still a holding that requires disclosure, no matter if the impact predates your tenure or not,” Cates said. He warned that omitting such information erodes public trust and that the public’s presumption is that the omission is intentional.

SpaceX incentives and the comptroller’s office

The comptroller’s office administers two tax‑break programs that together could exempt TeraFab AI, LLC—a special‑purpose entity linked to SpaceX—from roughly $1.7 billion in local school taxes through 2046, should the project be fully built. The state also provides Enterprise Zone Program incentives to SpaceX, overseen by the governor’s office but administered by the comptroller’s office. All of these incentives were approved before Huffines was sworn in, and the office continues to monitor compliance and enforce penalties where required.

Potential consequences for nondisclosure

State law makes it a crime to knowingly fail to file a disclosure form, but it does not automatically penalize omissions. Residents can file sworn complaints, prompting investigations that may result in fines or dismissal. The most severe penalty ever levied by the commission was a $100,000 fine against a judge for repeated nondisclosure.

What voters should know

Huffines won the Republican primary for comptroller in March and appears on the November ballot opposite Democrat Sarah Eckhardt. As the state’s chief financial officer, he oversees tax collection, state contracts, and revenue estimates. Voters will need to consider both his policy record and his adherence to transparency standards when casting their ballots.
