Temu Fined $232 Million by EU for Unsafe Products

The European Union has imposed a substantial fine of 200 million euros ($232 million) on Temu, a Chinese online retailer, following an investigation that revealed the sale of unsafe toys and electronics on its platform. The EU’s decision underscores the importance of consumer safety and compliance with regulations.

Consumer Safety Concerns

The investigation found that Temu failed to protect consumers from illegal products, including toxic toys and unsafe electronic devices. The European Commission’s findings were based on a ‘mystery shopping exercise’ that identified numerous non-compliant products. Many electronic device chargers failed basic safety tests, and a significant percentage of baby toys posed safety risks due to chemical content or detachable parts that could cause suffocation.

Digital Services Act Enforcement

The fine was issued under the Digital Services Act (DSA), a comprehensive rulebook that mandates online platforms to safeguard users from harmful content and products. This is the second fine issued under the DSA, following a $120 million penalty against Elon Musk’s social media platform X last year. The European Commission emphasized that risk assessments are critical and should not be treated as mere formalities.

Temu’s Response

Temu has expressed disagreement with the decision, describing the fine as ‘disproportionate.’ The company stated that the decision was based on an evaluation from 2024 and does not reflect current improvements in their systems. Temu claims to have engaged constructively with the Commission and has taken steps to enhance platform governance and user protection.

Future Compliance

Temu has been given until the end of August to submit an action plan to address the issues identified. Failure to comply could result in additional fines. The company, owned by PDD Holdings Inc., is popular for offering affordable goods from China and has a significant user base in the EU.
