Slim Chickens franchise in Sioux Falls contests EEOC discrimination lawsuit

Sioux Falls, SD – The proprietor of the local Slim Chickens franchise, operating under TNT Chicken Inc., has formally answered a federal lawsuit filed by the Equal Employment Opportunity Commission (EEOC). The EEOC alleges that a former employee, identified as a Black woman, endured repeated racial slurs, sexual harassment and a death threat from her shift leader while working at the restaurant.

EEOC complaint details

The complaint, filed last month, describes a hostile work environment in which the employee was subjected to demeaning language based on her race and gender. According to the EEOC filing, the shift leader not only used offensive epithets but also threatened to kill the employee, creating an unsafe atmosphere that the agency says violates Title VII of the Civil Rights Act.

Franchise owner’s response

In a filing with the U.S. District Court, TNT Chicken Inc. denied the EEOC’s allegations. The company’s answer asserts that the claims are unfounded and that the franchise has policies in place to prevent discrimination and harassment. The response states that any alleged misconduct was investigated promptly and that appropriate corrective action would have been taken if substantiated.

“We take all allegations of workplace misconduct seriously and are committed to providing a respectful environment for all employees,” the franchise’s legal counsel wrote. “The EEOC’s claims are without merit, and we will defend our right to operate our business without unwarranted government interference.”

Legal context

The EEOC’s lawsuit seeks remedies that could include back pay, reinstatement, and damages for emotional distress, as well as a court order requiring the franchise to implement stronger anti‑harassment training. Federal law requires employers to maintain a workplace free from discrimination based on race, color, religion, sex, or national origin.

Legal experts note that while the EEOC’s involvement signals serious concerns, many such cases are settled before reaching trial. “Both parties typically weigh the costs of prolonged litigation against the potential outcomes,” said a local attorney familiar with employment law.

Impact on the community

Sioux Falls residents have expressed mixed reactions. Some community members emphasize the importance of holding businesses accountable for workplace conduct, while others caution against assuming guilt before a court determines the facts. Local business groups have urged a fair process, noting that the outcome could affect how franchisees across the region handle employee relations.

The case also highlights broader conversations about workplace culture in the fast‑food industry, where turnover is high and supervisory staff often have significant authority over frontline workers.

Next steps

The lawsuit remains active, and a court hearing is scheduled for later this year. Both the EEOC and TNT Chicken Inc. are expected to present additional evidence and witness testimony. Until a judgment is rendered, the franchise will continue operating its Sioux Falls locations.
