Rep. Max Miller, an Ohio congressman, is facing a lawsuit from his ex-wife, Emily Moreno, over the accidental release of a sensitive photo of their 2-year-old daughter. The photo was shared by Miller and his attorney, Aaron Minc, in an effort to defend himself against domestic abuse allegations.

The lawsuit, filed in Ohio federal court, claims that Miller “recklessly published” the image, which was taken in the context of an inquiry into an injury the child had suffered. Minc took responsibility for the image being included in the link, stating it was an unintentional mistake.
Miller had released the materials following a livestream on August 2, linking to the files on his X account, where he has nearly 60,000 followers. The image was publicly available for about a day before being removed.
Emily Moreno’s attorney, Subodh Chandra, stated that the child is an “entirely innocent victim who has become collateral damage to her father’s political ambition.” The lawsuit seeks $150,000 in damages for each time the photo was downloaded.
