In Phoenix, a lawsuit has been filed against the Spencers, parents of an 18-year-old who hosted a ‘Senior Ditch Day’ party where alcohol was allegedly provided to minors. The incident took place on April 13 at their property near 40th Street and Chandler Blvd.
The lawsuit claims that the Spencers allowed their son to host the party, which was attended by over 60 high school students, including the 17-year-old plaintiff. The complaint alleges that the Spencers not only permitted the presence of alcohol but also provided it, leading to reckless behavior such as jumping off the roof into the swimming pool.
The plaintiff, who consumed alcohol at the party, was injured and required hospitalization. His blood alcohol concentration was recorded at .114, significantly above the legal limit of .08 for adults over 21 in Arizona.
The lawsuit accuses the Spencers of failing to maintain a safe environment and exercising reasonable care in supervising the event. It also states that they were notified to preserve all evidence related to the incident, including photos, videos, and communications.
In response, Mr. Spencer has stated that they are hiring a lawyer due to what they believe are false claims in the lawsuit. Further communications will be handled by their attorney.
