Ohio Supreme Court Clarifies Sex Offender Registration for Temporary Work Sites

The Ohio Supreme Court issued a unanimous decision Tuesday that sharpens the definition of “place of employment address” under the state’s sex offender registration statutes. The ruling means a registered offender must register in any county where he actually performs work, regardless of where the employer’s main office is located.

Case background

The case involved Christopher Smith Jr., a Tier III offender convicted of failing to register in Geauga County after being assigned to a children’s summer camp. Smith was employed through the Center for Employment Opportunities, a Cleveland‑based nonprofit that places formerly incarcerated individuals in jobs. Through that program he was assigned to Immaculate Cleaning, a janitorial firm that services sites across northeastern Ohio.

Each workday Smith and other employees met a company van driver in Cleveland and then traveled to their assigned job sites. In June 2023 he was sent to Camp Wise, a children’s summer camp in Geauga County, where he worked for several weeks. He was arrested on June 21, 2023, after Geauga County sheriff’s deputies alleged he had not registered as required.

Legal issue

Smith argued that the phrase “place of employment” was ambiguous and should be read to mean the physical location of the employer’s business rather than the temporary work site. The trial court rejected that argument, holding that the relevant employment location is where the offender spends the majority of his workday on a regular basis. Smith entered a no‑contest plea and received a three‑year community‑control sentence.

After appealing to the Eleventh District Court of Appeals, which affirmed the trial court’s ruling, Smith petitioned the Ohio Supreme Court for review. The high court agreed to hear the issue in September 2025 and issued its decision in a unanimous opinion.

Supreme Court reasoning

The justices said the plain meaning of “place of employment address” refers to the location where an offender is physically present while performing work. While acknowledging that this interpretation could require registration in multiple counties for workers with mobile assignments, the court rejected that concern, noting that the provision must be read in conjunction with other statutory requirements.

Ohio law also mandates registration when an offender has been employed in a county for more than three days or for a combined total of at least 14 days during a calendar year. The court found that Smith’s several‑week stint at Camp Wise satisfied that threshold, thereby obligating him to register in Geauga County.

Implications

The decision does not automatically create a new registration obligation for every brief assignment. Instead, it reinforces the statutory time‑requirements that determine when registration is required. The ruling provides Ohio courts with a clearer standard for interpreting “place of employment” in future disputes.

Legal experts note that the ruling could affect registered offenders employed in industries with frequent temporary or mobile assignments, such as cleaning services, construction, seasonal work, and other occupations that require travel between counties.

For Smith, the Supreme Court’s opinion leaves his third‑degree felony conviction intact and upholds the three‑year community‑control sentence imposed by the trial court.

Ohio’s registration system remains unchanged, but law‑enforcement agencies and courts now have clearer guidance on how to apply the employment‑address provision. Offenders and their employers are advised to track work locations carefully to ensure compliance with the registration timeline.
