The New Mexico State Ethics Commission has filed a lawsuit against the New Mexico Corrections Department, alleging a violation of state law for sharing personal information with Immigration and Customs Enforcement (ICE). According to the ethics commission, the Adult Probation and Parole Division of the Corrections Department disclosed the immigration status and national origin of probationers to ICE, which is prohibited under the Sensitive Personal Information Act.
The ethics commission claims that at least four probationers in New Mexico have been taken into ICE custody due to the alleged disclosure of information by the department. The Corrections Department has stated that it will not comment on pending litigation but generally meets with and trains probation and parole staff to ensure they are aware of current laws, policies, and expectations while supervising individuals in the community.
