Background on the BOI Mandate
In 2025, President Trump freed over 32 million American small businesses from the costly and unconstitutional BOI reporting requirements, saving small business owners more than $128 billion in red tape and compliance costs. However, the NFIB argues that the job is not finished, as Congress must act now to permanently repeal this intrusive and unconstitutional law.
The NFIB is urging Leader Steve Scalise to support efforts to repeal the BOI mandate and for the Financial Crimes Enforcement Network (FinCEN) to immediately destroy all BOI data already submitted by U.S. small businesses. The organization believes that if the mandate is not fully repealed, 32 million small businesses nationwide would once again be subjected to this unnecessary and invasive requirement, with those who fail to comply facing criminal and civil penalties.
