NFIB Pushes for Repeal of Beneficial Ownership Information Mandate

The National Federation of Independent Business (NFIB), a prominent advocate for small businesses, has launched a new advertising campaign aimed at urging Congress to permanently repeal the Beneficial Ownership Information (BOI) mandate. This mandate, which the NFIB argues is unconstitutional, requires small businesses to report ownership information to the Financial Crimes Enforcement Network (FinCEN).

Impact on Small Businesses

The NFIB’s campaign highlights the significant burden that the BOI mandate places on small businesses across the nation. According to NFIB President Brad Close, the mandate could impose over $128 billion in regulatory burdens and compliance costs on American small businesses. In 2025, President Trump had exempted more than 32 million small businesses from these requirements, but the NFIB stresses the need for a permanent legislative solution to prevent the mandate’s return.

The advertisements, which are being aired in key states including Florida, New Jersey, Louisiana, South Carolina, Alabama, Mississippi, South Dakota, and Washington D.C., call for Congress to not only repeal the BOI law but also to require FinCEN to destroy all data already submitted by small businesses under this mandate.

Constitutional Concerns

The NFIB argues that the BOI mandate infringes on constitutional rights by imposing unnecessary and invasive reporting requirements. The organization is actively working in Congress, executive branch agencies, and federal courts to block and repeal the mandate permanently. Failure to repeal the mandate could subject small business owners to severe penalties, including up to two years in federal prison and fines of up to $10,000 for non-compliance.
