The National Federation of Independent Business (NFIB) has joined a lawsuit against Oregon’s Labor Tax Bill, which was passed by the state legislature and signed into law by Governor Tina Kotek. The bill amends Oregon’s labor laws to pay for new positions within the Oregon Bureau of Labor and Industries (BOLI) using a newly created expense fund.
Constitutional Concerns
According to the lawsuit, the bill’s passage violates the state constitution, which requires revenue-raising measures to pass by a three-fifths majority. NFIB, along with other business groups, had repeatedly warned state lawmakers about this concern during the legislative session, but it was ignored.
NFIB is joined in the lawsuit by the Oregon Business & Industry association and the Portland Metro Chamber. This is the fourth legal case NFIB Oregon is involved in this year.
