New York appoints special prosecutor to re‑examine Cornell assault case

New York Governor Kathy Hochul announced Thursday that she has appointed State Attorney General Letitia James as special prosecutor to take over the investigation into the alleged 2024 gang rape of a former Cornell University student. The decision follows intense criticism from students, parents, faculty, and community members who said the original probe by Tompkins County District Attorney Matthew Van Houten was inadequate.

Why the state stepped in

Governor Hochul said she had “lost faith” in the county DA’s ability to fairly oversee the case, noting that new information has raised serious questions about how the investigation was handled. The special prosecutor will have the authority to re‑examine all evidence, interview witnesses, and, if warranted, present the case to a grand jury.

Campus reaction

Students gathered at a public forum on Cornell’s campus, where student assembly president Eeshaan Chaudhuri expressed collective shame over the events. Junior Sophia Riley Sim described a “mental health crisis” among students still grieving the assault. Others, such as junior Jane Wang, recounted personal experiences with the university’s Title IX process, saying they felt abandoned by the institution.

Senior editor Cereese Qusba of The Cornell Daily Sun noted that the campus atmosphere feels like a reckoning, comparing it to the national MeToo movement a decade ago. She warned that the university cannot simply return to the status quo after the renewed scrutiny.

Details of the original investigation

According to court documents and reporting by CNN, the alleged assault occurred at the Chi Phi fraternity house on October 19, 2024. The victim, identified as Jane Doe, reported the incident to campus police three weeks later. Police condensed her lengthy interview into a six‑page statement that omitted her unequivocal claim that she had been raped. The statement, along with Snapchat messages from a group chat titled “Chi Phi Actives,” was forwarded to the county DA.

Van Houten’s office declined to bring criminal charges, citing the victim’s signed statement, which they said did not contain sufficient criminal conduct. He also claimed that additional evidence, including a November 2024 interview transcript in which Doe said she was “100% confident” she was raped, was not provided to his office.

University response

Cornell maintains that it followed protocol and shared all investigatory information with the DA. The university declined to confirm individual disciplinary outcomes, citing federal student privacy law, but indicated that policy violations could lead to suspension or expulsion. The Chi Phi chapter was banned from campus in 2024, and a university task force on sexual assault issued a final report earlier this year.

What comes next

Attorney General James will hold a news conference on Friday to outline the next steps for the special prosecutor’s office. The investigation will review the original police interview, the Snapchat evidence, and the university’s Title IX findings, which reportedly identified at least one student as having violated policy against sexual exploitation.

Community leaders and faith‑based groups have called for a transparent process that respects the dignity of the victim while upholding due process for the accused. The state’s involvement underscores a commitment to ensuring that justice is pursued fairly and thoroughly, reflecting the values of personal responsibility and the rule of law.
