Michigan Senate approves dam safety overhaul, moving reforms toward Governor Whitmer

The Michigan Senate took a decisive step on Thursday, voting to overhaul the state’s lax dam safety laws. The legislation, championed by Democratic Sen. Mallory McMorrow of Royal Oak and Republican Rep. Bill G. Schuette of Midland, would tighten flood‑control standards, increase inspections and require dam owners to demonstrate they can maintain their structures.

Legislative path forward

The Senate’s approval included substitute language for House Bill 5485, meaning the bill must return to the House for concurrence before it can be sent to Governor Gretchen Whitmer for signature. Rep. Schuette expressed confidence that the House will act quickly, noting that the companion Senate Bill 947 passed the lower chamber last week.

Both bills are intended to address what many experts describe as some of the nation’s weakest dam safety standards. Michigan’s dams, many of which average about 80 years old, have long been flagged for inadequate flood‑control capabilities. A Bridge Michigan investigation in June found that more than 100,000 state residents live in the potential flood path of a high‑hazard dam, putting lives and property at risk.

Why reform matters

Recent dam failures in mid‑Michigan caused over $200 million in damages, and a wave of flooding this spring led to additional failures and near‑failures. “While we can’t undo what happened across our region in 2020, we can and should prioritize a better way forward,” Rep. Schuette told Bridge Michigan. He called the legislation “a huge win for communities and families across our state who have homes and livelihoods near high‑hazard dams.”

Nationally, high‑hazard dams must be capable of withstanding 100 % of the so‑called probable maximum flood—the worst‑case scenario for the surrounding area. Michigan’s current standards are less than half as stringent, leaving many structures vulnerable.

Funding and implementation

Lawmakers allocated millions of dollars in July to shore up problem dams and boost staffing for the Michigan Department of Environment, Great Lakes and Energy’s dam safety unit. The funding aims to ease concerns that stricter standards would impose costly upgrades that local communities could not afford.

Statewide, Michigan’s roughly 2,600 dams need a collective $1 billion in repairs and updates. The new legislation would give regulators clearer authority to require owners to address deficiencies, conduct regular inspections and maintain emergency action plans.

Looking ahead

If the House concurs with the Senate’s version, the bills will move to Governor Whitmer’s desk. Supporters hope the reforms will prevent future failures, protect families, and bring Michigan’s dam safety regime in line with national best practices.

Stakeholders, including dam owners, local officials and residents living downstream, will be watching the next steps closely. The reforms represent a significant shift toward proactive risk management for a critical piece of the state’s infrastructure.
