Current penalties fall short
Louisiana law allows fines up to $32,500 per day for illegal tire dumping, but most violations are prosecuted as gross littering, a misdemeanor with a starting fine of $900. By contrast, neighboring states such as Texas treat large‑scale illegal dumping as a felony, imposing jail time of up to two years and fines of $10,000.
Kevin Scott, director of the Louisiana Department of Environmental Quality’s criminal investigation division, explained that enforcement is uneven. Some jurisdictions, like New Orleans, pursue cases aggressively, while others rarely bring charges. He cited a Caddo Parish case where an arrest warrant expired before trial.
Proposed deterrents and funding solutions
Susan Russell, executive director of Keep Louisiana Beautiful, urged the task force to consider tying penalties to business licenses. “We need to hit them in the pocketbook,” she said, noting that no mechanism currently exists to revoke operating permits for repeat offenders.
Scott presented data showing a sharp rise in illegal‑dumping complaints: 91 leads in fiscal year 2021‑22 versus 458 last year, with 2026‑27 on track to exceed that number. He also pointed out the cost disparity—clean‑up expenses range from $230 to $600 per ton, far exceeding the typical $900 gross‑littering fine.
Funding the cleanup effort
The state collects a tire‑sale fee of $2.25 to $10 per tire, which is placed in an escrow account to pay recyclers. However, the recycling fee charged by garages stays with the business and is often used to pay haulers who transport tires to approved sites. Russell stressed that any new deterrent measures must be funded, suggesting the task force explore additional revenue sources.
Beyond tires, the task force discussed illegal dumping of appliances and mattresses, noting that furniture often ends up in the streets after evictions or the clearing of homeless encampments in New Orleans.
Next steps
The task force, chaired by LDEQ Deputy Secretary Nathan McBride, will meet monthly through January, traveling to different locations across the state. Recommendations are expected by February, giving lawmakers a clear roadmap to strengthen Louisiana’s anti‑dumping laws and protect neighborhoods.
