Justice Elena Kagan, one of the Supreme Court’s three liberal justices, stated that the Court is not a rubber stamp for President Donald Trump. Kagan made this statement during a speech to lawyers and judges from the 9th U.S. Circuit in Bellevue, Washington.

Checking the Executive Branch

Kagan pointed out that the Court has checked the executive branch in significant cases, such as rejecting Trump’s sweeping tariffs and his efforts to strip birthright citizenship from the children of people who are in the U.S. illegally. The Court has largely upheld Trump’s immigration crackdown and expanded his authority over federal regulatory agencies.

Kagan emphasized that while the Court is conservative, it is not a puppet for the current administration. She also reiterated her support for appointing a committee of retired judges to enforce the Supreme Court’s first code of ethics, adopted in 2023.

Kagan reflected on a historic moment from the Court’s past term when President Trump attended oral arguments over his birthright citizenship order. Trump was the first sitting president to attend oral arguments and remained for about half of the lengthy arguments.
