Judge blocks Jerry Sandusky’s attempt to present recantation testimony

Bellefonte, Pa. — In a remote hearing on Tuesday, former Penn State assistant coach Jerry Sandusky, 82, appeared via video from Laurel Highlands State Prison and confirmed his decision, on counsel’s advice, not to move forward with testimony from an accuser seeking to recant the sexual‑abuse allegations presented at his 2012 trial.

Judge’s ruling limits further litigation

Centre County Judge Maureen Skerda told Sandsand’s attorney, Jerry Russo, and the former coach that withdrawing the request to present the recantation means the issue cannot be litigated again in either state or federal court. The judge’s order effectively ends the latest procedural attempt to reopen the case based on the alleged recantation.

Lawyers’ strategy shifts to federal court

Russo explained that courts generally view new‑trial motions grounded in a witness’s recantation as “inherently unreliable.” Consequently, the defense plans to take broader new‑trial arguments to federal court after completing one more procedural appeal at the state level. This follows at least three prior attempts in state courts to secure a new trial for Sandusky.

Accuser’s recantation deemed suspect

The Pennsylvania Office of Attorney General described the purported recantation as “highly suspect.” In court filings, Sandusky’s lawyers argued that the accuser, identified only as R.R., was influenced by “suggestive leading questioning, prosecutorial coercion and influence, confirmatory bias and memory manipulation.”

Background of the original case

Sandusky, a former defensive coordinator under Hall of Fame head coach Joe Paterno, was convicted in 2012 on 45 counts of sexual abuse after eight young men testified about abuse they suffered as boys. The scandal led to Paterno’s dismissal and resulted in the university paying more than $100 million to victims. Authorities also linked Sandusky to the charity The Second Mile, which he founded for at‑risk youth, alleging he used the organization to find and groom boys.

R.R., who was 25 at the time of the 2012 trial, testified that he was abused by Sandusky in the coach’s basement in 1998 when he was 11 years old. Despite repeated claims of innocence from Sandusky, the conviction has stood.
