A federal judge has ruled that Idaho’s Defense of Life Act violates the Constitution’s 14th Amendment. The law, which makes it a crime for doctors to perform abortions in the state, including when the health of the mother is at stake, will be appealed and possibly taken to the United States Supreme Court.

The lawsuit was brought by a Boise doctor, who alleged that the law would prevent doctors from performing abortions even when necessary to save the life of the mother. The Idaho Family Policy Center’s president, Blaine Conzatti, stated that the ruling is an example of an activist opinion attempting to invent a right to abortion that does not exist in the Constitution.
