Federal Warning to Colorado School District Over Title IX Non-Compliance

The U.S. Department of Education’s Office for Civil Rights (OCR) has issued a formal warning to Jefferson County Public Schools in Colorado, citing non-compliance with Title IX regulations. The district has been given a 10-day deadline to comply or face potential termination of its federal education funding.

Title IX Violations

Title IX is a federal law that prohibits sex-based discrimination in education programs receiving federal funds. The OCR’s investigation revealed that the district allowed male students to participate on girls’ sports teams, access female restrooms and locker rooms, and share overnight accommodations based on their gender identity. Additionally, policies were in place allowing students as young as 11 to share overnight rooms with members of the opposite sex during school trips.

The investigation began in June 2025, initially focusing on the district’s overnight accommodation policies, but later expanded to include athletic rosters and locker room access. Despite being provided with a proposed Resolution Agreement to address these issues, the district has not implemented the necessary changes.

Federal Response

Assistant Secretary for Civil Rights Kimberly Richey criticized the district’s response, stating that it trampled on females’ sex-based protections and failed to address the safety, privacy, and dignity of women and girls. Richey emphasized the importance of restoring Title IX protections, warning that failure to comply could lead to further enforcement actions.

As the nation observes June as Title IX Month, the Trump Administration has made it clear that it will not tolerate what it views as a radical ideological agenda undermining basic protections under the law. Jefferson County Public Schools now has a limited window to enter into a compliance agreement with the federal government to avoid enforcement proceedings.
