Federal appeals court pauses extra eligibility year for 2022 college athletes

A three‑judge panel of the U.S. 10th Circuit Court of Appeals in Denver issued a stay on Friday that temporarily blocks a district‑court order granting an extra year of eligibility to athletes who graduated high school in 2022. The order, which had been expected to take effect just days before the start of the college football season, would have allowed thousands of former players to return for a fifth year of competition.

Legal background

Last month, a federal district court ruled in favor of the plaintiffs – a group of former student‑athletes whose eligibility ended after the 2025 season. They argued that the NCAA’s new five‑year eligibility rule, set to begin next season, should apply to them as well, giving them access to continued education and name‑image‑likeness (NIL) compensation.

The NCAA countered that schools had already built rosters based on the existing rules and that allowing a sudden influx of players would be unfair to current team members. In its filing, the association said, “fairness is in the eye of the beholder.”

Impact on fall sports

The stay means the pending appeal will be heard before any further action, leaving many programs in limbo as they finalize rosters for the 2026‑27 season. Football powerhouses such as TCU and North Carolina are scheduled to play opening games next Saturday, one of eight matchups on the first day of major college football.

Basketball programs also face uncertainty. Gonzaga, for example, recently added two players – Javon Bennett from Dayton and Chauncey Wiggins from Florida State – who each won separate eligibility lawsuits in state courts. Coaches worry about committing roster spots to athletes who might later be declared ineligible.

Broader legal landscape

The NCAA’s chief legal officer, Scott Bearby, sent a memo to member schools stating they would not be penalized for players who competed before the stay was issued, but reiterated that those athletes are no longer eligible under the current rules.

Bearby also indicated the association will continue to defend similar cases in state courts, acknowledging that the federal stay does not guarantee an end to the nationwide confusion created by the new eligibility rule. Additional appeals are expected.

Recent state‑court decisions

Earlier this week, former Ole Miss starters Dae’Quan Wright, Zxavian Harris and Wydett Williams secured rulings from a Louisiana state court granting them another season of eligibility, despite having signed NFL contracts.

These developments highlight the ongoing tension between the NCAA’s governance and individual athletes’ rights to pursue further education and NIL opportunities.
