EPA Guidance Supports Trump Data Center Plan

The U.S. Environmental Protection Agency (EPA) issued new permitting guidance this month, clarifying that off-grid power generation facilities are exempt from the Clean Air Act’s Acid Rain Program. This policy change applies specifically to ‘islanded’ power facilities, which are generating plants that operate completely independent of the public electricity grid.

Impact on Data Center Construction

Under the revised framework, tech developers building dedicated power sources for data centers will not fall under Acid Rain Program requirements, provided the facilities do not sell electricity or report to the U.S. Department of Energy as standard generating units. Federal officials state the decision is designed to speed up data center construction while insulating residential electricity customers from rising utility costs.

The update ties into President Donald Trump’s Ratepayer Protection Pledge, an initiative expanded during an event at EPA headquarters. Under the pledge, participating companies commit to building, purchasing, or supplying all energy required for their projects, while covering the full financial cost of the supporting infrastructure.

‘Ensuring that the United States maintains our artificial intelligence dominance is essential to national security and economic prosperity. At the same time, it is equally important that we safeguard our communities from utility price hikes,’ said EPA Assistant Administrator for Air and Radiation Aaron Szabo. ‘This guidance will provide an avenue to do both. EPA is proud to further the President’s agenda through commonsense approaches to regulating.’
