Education Dept Rescinds Race-Based Discipline Guidance Under Title VI

The U.S. Department of Education announced on July 23, 2026 that its final rule rescinds the disparate‑impact provisions of Title VI regulations, directing schools that receive federal funds to apply discipline policies without regard to race. Background

In 2014, the Obama administration’s Department of Education and Department of Justice issued a Dear Colleague Letter stating that even facially neutral discipline policies could violate Title VI if they resulted in a “disparate impact” on students of a particular race. Executive Orders and New Rule

President Trump signed Executive Order 14280 on April 23, 2025, titled “Reinstating Commonsense School Discipline Policies,” directing the Secretary of Education, in consultation with the Attorney General, to issue new guidance that would prohibit race‑based discipline. The same day he signed Executive Order 14281, “Restoring Equality of Opportunity and Meritocracy,” which framed disparate‑impact liability as inconsistent with equal‑protection principles.

Following those orders, the Department of Education released its final rule on July 23, 2026. The rule removes the disparate‑impact language from 34 C.F.R. Part 100 and emphasizes that Title VI applies only to intentional discrimination. It also reaffirms that schools may continue to use flexible, neutral policies and exercise teacher or administrator discretion, provided decisions are made without regard to race.

Secretary of Education Linda McMahon said on X, “For too long, the left’s pursuit of ‘equity’ has perversely required schools to discipline students differently, based on their race. The Trump Administration is committed to keeping classrooms safe and holding schools accountable for discrimination.” Assistant Secretary for Civil Rights Kimberly Richey added, “A child is so much more than a number in a data set. The left’s notion of ‘equity’ should never prevent teachers from keeping their classrooms and students safe.”

What the Guidance Means

For students, disciplinary decisions will now be based on individual conduct rather than attempts to balance suspension or expulsion rates across racial groups. For parents, the change clarifies that schools remain liable for intentional race discrimination but are no longer pressured to alter discipline solely to meet statistical benchmarks. Teachers and administrators regain the ability to enforce rules without fearing investigations triggered by disparate‑impact data.

The guidance applies to all public and private educational institutions and state education agencies that receive federal financial assistance. It is interpretive, not a new statutory requirement, and does not impose additional obligations beyond existing constitutional and statutory standards.
