Roxie Ellis Douglas, a resident of Chicago, has filed a lawsuit in the U.S. District Court for the Northern District of Illinois against Wendy’s. She claims she became seriously ill after eating a double cheeseburger and baked potato that were delivered to her home through DoorDash on or around August 5, 2025.
According to the complaint, Douglas contracted a Campylobacter intestinal infection, which progressed to acute infectious colitis, leukocytosis, dehydration, gastroenteritis, and hypokalemia secondary to diarrhea. The lawsuit alleges the food was contaminated with bacteria when it left Wendy’s control.
Legal claims
The complaint accuses Wendy’s of strict product liability, negligence, and breach of the warranty of wholesomeness. It asserts the chain failed to use safe and proper food storage, preparation, and handling practices, failed to adequately prepare the meal for human consumption, and failed to eliminate the presence of Campylobacter and other illness‑producing bacteria.
Medical costs
Douglas’ medical expenses related to the illness total $93,578, including two separate hospitalizations. The amount exceeds the $75,000 threshold that allows the case to be heard in federal court, a point Wendy’s has raised in its motion to keep the lawsuit in federal jurisdiction.
Company response
Wendy’s has not yet commented on the lawsuit. NBC Chicago reached out for a statement.
