Chicago Attorney Explains How Illinois Calculates and Enforces Child Support

Income‑shares model drives the calculation

Illinois follows an income‑shares approach, which combines both parents’ net incomes and allocates the child’s needs proportionally. “The model is meant to reflect what the household would have spent on the child if the parents lived together,” Caesar said. The court first determines each parent’s monthly net income, adds the figures together, and then consults the HFS Schedule of Basic Child Support Obligations to find a baseline amount.

That baseline is divided according to each parent’s share of the combined income. The parent with the majority of parenting time is presumed to spend their portion directly on the child. Health‑insurance premiums, uninsured medical costs, and reasonable work‑related child‑care expenses may also be apportioned based on net income.

What counts as income

Under 750 ILCS 5/505, income includes wages, salaries, commissions, bonuses, self‑employment earnings, rental income, pensions, and certain benefits. Means‑tested public assistance such as Supplemental Security Income is excluded. If a parent is voluntarily unemployed or underemployed, the court may impute income based on work history, education, job skills, and the local job market, but only after an evidentiary hearing or a party agreement.

When courts can deviate

Courts may depart from the guideline amount if the standard calculation would be unjust, considering each parent’s resources, the child’s needs, and any extraordinary expenses. Shared parenting also changes the formula: if each parent has the child for 146 or more overnights per year, the basic obligation is multiplied by 1.5 to reflect the cost of maintaining two households.

Establishing and modifying orders

Parents must have a court order or an approved administrative order from the Illinois Department of Healthcare and Family Services before support can be collected. In Cook County, a petition is filed through the Domestic Relations Division via eFileIL, and both parties must submit a sworn Financial Affidavit with tax returns, pay stubs, and bank statements. Unmarried parents first need to establish legal parentage through a Voluntary Acknowledgment of Parentage or a court determination under the Illinois Parentage Act of 2015.

To modify an order, Illinois law requires a substantial change in circumstances—such as a significant income shift, involuntary job loss, or a new parenting‑time schedule—under 750 ILCS 5/510(a). A modification affects only future installments after proper notice is given.

Enforcement tools

If payments stop, the state offers several enforcement mechanisms: income withholding, contempt proceedings, tax‑refund intercepts, driver’s‑license suspension, passport denial, and property liens. Courts may also award attorney fees to the parent who initiates enforcement under 750 ILCS 5/508(b).

For interstate cases, the Uniform Interstate Family Support Act governs jurisdiction, enforcement, and modification across state lines. The state that issued the original order retains exclusive jurisdiction as long as a party or the child continues to reside there, though an out‑of‑state order can be registered in Cook County for enforcement.

Duration of support

Illinois generally requires support until the child turns 18, or until high‑school graduation or age 19, whichever occurs first. Additional provisions exist for disabled adult children and for college or post‑secondary expenses.
