Casper City Council Proposes Temporary Halt on New Gambling Venues

The Casper City Council has taken a significant step by approving the first reading of a 180-day moratorium on the establishment of new gambling venues, including simulcasting and gaming facilities. This decision, made during the council’s Tuesday meeting, aims to provide city officials with the necessary time to evaluate the long-term land-use impacts of such businesses.

Evaluating Community Impact

City staff plan to use this pause to assess various factors such as spacing standards, potential zoning district restrictions, and buffering requirements. The goal is to ensure that future developments align with the community’s long-term land-use plans and character. City Manager Janine Jordan highlighted that gambling establishments bring several land-use considerations, including parking demands and hours of operation, which can be exacerbated by the concentration of these businesses in certain areas.

While Councilor Amber Pollock views the moratorium as a means to address zoning regulation issues, Mayor Ray Pacheco and Vice Mayor Kyle Gamroth support the pause due to concerns about gambling addiction and public health risks. Gamroth, drawing from his experience as a former mental health professional, emphasized the potential public health impacts associated with an increase in gambling establishments.

Debate Over Business Freedom

Not all council members agree with the moratorium. Councilor Gena Jensen opposed the measure, arguing that it interferes with private business operations. She considers gambling machines a form of adult entertainment and believes the city should not dictate business locations. Local business owner John Johnson echoed these sentiments during the public comment portion, suggesting that the moratorium shows bias against certain business sectors and advocating for free enterprise.

Despite these objections, the council voted 7-2 in favor of the moratorium on its first reading, with Jensen and Councilor Pat Sweeney dissenting. The ordinance would allow existing gaming businesses to continue operations but prohibit any expansion during the six-month period.

Legal and Legislative Considerations

Attorney Affie Ellis, representing Bally’s, expressed concerns that the moratorium would unfairly benefit existing businesses while penalizing new entrants. Recent changes in state law, particularly Senate File 45, influenced the council’s decision. This legislation requires local approval for future historic horse racing locations starting July 1, providing the council with criteria to potentially deny new applications.

Currently, Casper hosts eight historic horse racing locations within its municipal boundaries. The council retains the authority to extend or repeal the moratorium based on the progress of their review. The proposed moratorium must pass two more readings before it can be enacted.
