Carmel Police Shooting Leads to Six Felony Charges for Indiana Man

On August 6, a traffic stop on U.S. 31 near 116th Street in Carmel turned violent when Jacob D. Berry, a 27‑year‑old Indianapolis resident, exited his truck brandishing a newly purchased .22‑caliber rifle. According to Hamilton County court records, Berry pointed the firearm at a Carmel police officer who was attempting to pull him over for speeding. The officer responded with multiple shots, striking Berry and causing him to drop the rifle.

Berry, who was traveling south at an estimated 95 mph, had been flagged by his own father, who called police earlier that day. The father warned officers that his son had expressed suicidal thoughts and had told him he wanted to die by “suicide by cop.” He also disclosed that Berry possessed the .22‑caliber rifle.

After the initial discharge, investigators say Berry continued to reach for the weapon. A lieutenant who arrived on scene also fired, adding further rounds to the encounter. Berry was transported to a local hospital with multiple gunshot wounds and is expected to survive. He has declined to speak with investigators and has requested counsel.

Charges and Legal Proceedings

On August 19, a Hamilton County judge formally charged Berry with six felony counts: two counts each of attempted aggravated battery, intimidation with a deadly weapon, and pointing a firearm at a police officer. The charges reflect the seriousness of confronting law‑enforcement officers with a deadly weapon and the potential threat to public safety.

Prosecutor Joshua Kocher confirmed that the two Carmel officers involved acted within the bounds of the law and will not face criminal charges. Both officers remain on administrative leave while the department’s internal investigation continues.

Evidence Supporting the Investigation

Investigators recovered a memory card from Berry’s truck that contained a video recording of Berry telling his mother he would point the rifle at police if they were called and that the officers would shoot him. This video was cited as additional evidence of Berry’s intent and the perceived danger to officers.

While the prosecutor’s office has affirmed the legality of the officers’ actions, community leaders are urging continued transparency and support for mental‑health resources.
