California guide firm fined $151K after deadliest modern avalanche kills nine

California’s Division of Occupational Safety and Health (Cal/OSHA) announced on August 12 that Blackbird Mountain Guides will pay $151,300 in penalties for seven alleged workplace violations tied to the February avalanche that killed nine backcountry skiers near Frog Lake in the Sierra Nevada.

What the agency says

The largest citation, an $81,000 fine, alleges the company failed to correct an “imminent hazard” by traveling in avalanche terrain while the danger level was rated high. Five additional violations relate to inadequate employee training and the delayed reporting of three employee deaths to the agency.

Details of the tragedy

The group of 15 skiers, three of whom were guides, set out on a three‑day trek organized by Blackbird Mountain Guides. They stayed in remote huts at 7,600 feet in Tahoe National Forest, carrying their own food and supplies. On February 17, while attempting to ski down Castle Peak, an avalanche struck, burying the party. Six skiers, including one guide, survived after sheltering in place for several hours and were rescued amid blizzard conditions.

All nine victims were members of the guided party; three of the deceased were guides employed by Blackbird Mountain Guides. The guides on the trip held certifications from the American Mountain Guides Association, which the company cites as the industry’s highest level of training.

Company response

Blackbird Mountain Guides has filed a formal appeal, asserting that it was in “full compliance” with all regulatory requirements. In a statement, the company said, “The citations do not reflect the reality of our profession or the safety program we have built. Mountain guiding takes place in dynamic wilderness environments where conditions change minute to minute—it’s not a controlled setting such as construction sites.” The firm expressed willingness to work with Cal/OSHA to clarify the unique challenges of backcountry operations.

Ongoing investigations

Cal/OSHA’s Bureau of Investigations continues to review the incident for possible criminal charges. The Nevada County Sheriff’s Department has forwarded its own criminal investigation findings to the district attorney’s office for further review. The district attorney’s office has not yet commented.

The fines and investigations underscore the tension between adventurous outdoor recreation and workplace safety regulations. While backcountry guiding offers families and faith‑based groups a way to experience God’s creation, it also demands rigorous safety protocols and clear communication of hazards.
