Two sons are suing a Boston assisted living facility, claiming their father’s body was left to decompose for over a week after his death. Felipe Dip’s sons, Ricardo Dip Calimano and Benjamin Dip Gerber, filed the lawsuit against Chestnut Park at Cleveland Circle, seeking $1 million in damages.
Allegations of Negligence
The sons claim that the facility and a staffer in charge of their father’s welfare were negligent in not checking on him, resulting in severe emotional distress. According to court documents, Dip was found in his room at the facility on July 21, 2023, with his body badly decomposed. The room’s motion detector last recorded movement on July 12, which the sons argue was the last day their father was alive.
A lawyer for the sons, Thomas E. Flaws, stated that the lawsuit was filed for transparency and to hold people accountable. “Mr. Dip was entrusted to the care of an assisted living facility that families rely on to keep their loved ones safe. The allegations in this case raise serious questions about whether that trust was honored,” Flaws said.
A spokesperson for Benchmark Senior Living, which operates the facility, disputed the allegations, stating that the health and safety of residents is their top priority. The spokesperson said that they strongly disagree with the description of the events and allegations contained in the lawsuit and will defend against them.
