Arkansas Secures $5.5 Million Settlement with Family Dollar Over Rat Infestation

Arkansas Attorney General Tim Griffin has announced a significant $5.5 million settlement with Family Dollar and Dollar Tree entities. This settlement resolves a consumer protection lawsuit stemming from a rat infestation at a distribution center in West Memphis, Arkansas. The state will receive $3.9 million, with $1.6 million of the settlement suspended due to Family Dollar’s cooperation with federal authorities.

Background on the Settlement

The lawsuit was initiated by the Attorney General’s Office in April 2022 after the U.S. Food and Drug Administration (FDA) conducted an investigation into the West Memphis facility. A publicly circulated video revealed the warehouse was overrun with rodents, prompting the FDA to determine that the facility had been infested since at least 2020. During this time, over 3,400 rodents were removed from the distribution center between March 2021 and January 2022.

Products from this facility were distributed to all 85 Family Dollar stores in Arkansas, as well as stores in five other states. Following the investigation, the FDA issued a public safety alert and oversaw a recall of FDA-regulated products from the facility.

Legal Actions and Implications

The Attorney General’s lawsuit accused Family Dollar of multiple violations, including the Arkansas Deceptive Trade Practices Act, failure to warn, and negligence. The lawsuit highlighted that consumer goods were stored under unsanitary conditions and that consumers were not adequately informed about these conditions.

In 2024, Family Dollar Stores, LLC accepted a guilty plea in a federal criminal case related to the infestation. As part of the plea agreement, the company faced a fine and forfeiture exceeding $41 million. This cooperation with the Department of Justice contributed to the suspension of $1.6 million from the Arkansas settlement.
