A divided federal appeals court ruled that President Donald Trump is unlawfully constructing a massive new ballroom at the White House, possibly leading to a high-stakes showdown before the Supreme Court.

The DC Circuit Court of Appeals said in a 2-1 ruling that each President is a temporary tenant, not the owner, of the White House and its Executive Residence. The court stated that the President has no constitutionally assigned authority over the property, which is designed and maintained for the use of all Presidents, current and future, and for the American people.
The court’s ruling sided with the nation’s top historic preservation group, which argued that Congress has not ceded unfettered authority to the Executive Branch to dramatically redesign, reshape, and reconstruct the White House.
The court has paused its ruling for two weeks to give Trump time to appeal to the Supreme Court.
