China Urges Panama to Resist External Pressure on Canal Operations

In a recent meeting at the United Nations Security Council, China’s Foreign Minister Wang Yi expressed Beijing’s commitment to strengthening ties with Panama. He urged the Central American nation to protect the rights of Chinese firms, particularly in light of recent tensions surrounding the Panama Canal. This call for cooperation comes amid U.S. pressure concerning Chinese-linked infrastructure near the canal, a vital waterway handling 5% of global maritime trade.

Legal and Economic Implications

The backdrop to these discussions includes a significant legal development in Panama. In January, Panama’s Supreme Court declared unconstitutional the legal framework that allowed CK Hutchison, a subsidiary of a Hong Kong-listed company, to operate two key container terminals at Balboa and Cristobal. These terminals, although separate from the canal itself, are strategically important due to their locations at the Pacific and Atlantic entrances.

The court’s decision, which also nullified a 2021 extension of the concession, has been met with opposition from Chinese and Hong Kong authorities. They have labeled the ruling as an ‘act of bad faith.’ The cancellation of the concession followed U.S. efforts to limit Chinese influence in the region.

International Arbitration

In response to the court’s ruling, CK Hutchison has initiated an international arbitration case against Panama, seeking over $2 billion in damages. The company accuses Panamanian authorities of unlawfully seizing property, a claim that adds another layer of complexity to the geopolitical and economic dynamics surrounding the canal.

As these developments unfold, the situation highlights the intricate balance of international relations, economic interests, and national sovereignty. The outcome of these tensions could have significant implications for global trade routes and the strategic control of the Panama Canal.
