Washington County Supreme Court Rejects Petition to Limit District Attorney’s Death Penalty Authority

The Pennsylvania Supreme Court issued a two‑page order on Friday refusing the “King’s Bench” petition filed by the Atlantic Center for Capital Representation, a Philadelphia‑based anti‑death‑penalty group. The petition sought to limit Washington County District Attorney Jason Walsh’s authority to pursue capital punishment in homicide cases.

Background of the petition

The petition, filed directly with the state Supreme Court in July 2025, was filed on behalf of Jordan Clarke and Joshua George, both accused of killing their infant sons and facing the death penalty if convicted of first‑degree murder. George was acquitted at trial last October and released, while Clarke remains jailed awaiting trial for the death of his son in May 2022.

Walsh, who became Washington County’s top prosecutor in August 2021 after the death of former District Attorney Gene Vittone, has aggressively pursued capital cases. He announced plans to seek the death penalty against nearly a dozen defendants in the five years since taking office and filed capital murder charges against ten defendants in the lead‑up to the 2023 general election.

Supreme Court’s decision

In its order, the court rejected the Center’s request to use the state’s “extraordinary jurisdiction” to review Walsh’s pursuit of the death penalty and to require an out‑of‑county judge’s approval for future cases. Instead, the court ruled that each capital case should be reviewed on an individual basis by post‑conviction courts.

Walsh called the filing “meritless, nonsensical, futile” and said it was driven by “politically‑motivated Philadelphia activists.” He praised the court for seeing “through this charade” and making a decision grounded in law.

Local impact and reactions

At its peak in 2024, Washington County had twelve pending death‑penalty cases—more than a quarter of all capital cases in Pennsylvania despite the county representing less than 2 % of the state’s population. Since then, three defendants have taken plea deals to lesser charges, Joshua George was acquitted, and charges were dismissed against Jah Sutton, who was accused of being an accessory to a fatal shooting in Donora in February 2021.

Frances Harvey, executive director of the Atlantic Center for Capital Representation, expressed deep disappointment, calling Walsh’s pursuit of the death penalty “reckless” and a “systemic and ongoing problem” that has cost people years of incarceration. She argued that the misconduct warrants a systems‑level response rather than isolated case reviews.

Next steps in Clarke’s case

With the Supreme Court’s denial, attention now turns to motions filed by Clarke’s defense attorneys in Washington County Court of Common Pleas. They have asked Judge Michael Lucas to dismiss the case, remove the death penalty option, or disqualify Walsh from prosecuting it. Clarke, 40, is accused of assaulting his 11‑week‑old son, Sawyer, who died on May 24 2022. His attorneys claim the infant’s injuries resulted from a slip on a plastic bag.

Clarke also filed a lawsuit against Walsh and other county officials over the decision to retain Sawyer’s body for several months rather than returning it to the family; that suit was dismissed by a senior visiting judge. The last hearing in the homicide case occurred in July, and a ruling on the defense motions remains pending. Clarke continues to be held without bond at the Washington County jail.
