U.S. Attorney urges Congress to raise federal fentanyl mandatory minimums

In a recent opinion piece, a U.S. Attorney highlighted the growing toll of fentanyl on families across the United States. The prosecutor explained that fentanyl now accounts for more deaths among Americans aged 18 to 45 than any other cause, with over 100 lives lost each day.

Fentanyl’s reach in everyday life

The attorney noted that fentanyl is frequently mixed into other drugs, sold as counterfeit prescription pills, and even hidden in seemingly innocuous items such as candy and baby bottles. One mother recounted losing her daughter after a sip of water contaminated with the substance, underscoring how the drug can appear in everyday settings.

Federal response and recent trends

According to the attorney, former President Trump issued five executive orders and other proclamations aimed at curbing the flow of fentanyl across the border. The attorney claims those actions, combined with stronger border security, have lowered the purity of fentanyl on the street—down from 19.5% to 10.3%—and reduced the percentage of lethal fentanyl pills from 76% in 2023 to 29% today.

Why mandatory minimums matter

Despite these gains, the prosecutor argues that current federal sentencing guidelines are insufficient. There is no mandatory minimum for trafficking up to 40 grams of fentanyl, a quantity capable of killing roughly 20,000 people. The minimum sentence only rises to five years for larger amounts, and to ten years for 400 grams, which could kill up to 200,000 individuals.

By comparison, federal mandatory minimums for methamphetamine are harsher—selling just 50 grams carries a ten‑year minimum—yet fentanyl kills twice as many people. The attorney contends that longer, mandatory‑minimum sentences would give prosecutors the tools needed to remove the most dangerous dealers and deter new participants.

State experiments with stricter penalties

States that have adopted stricter mandatory minimums appear to be seeing results. In North Carolina, a mandatory minimum of four grams carries a 19‑year sentence, while Alabama imposes a 25‑year minimum for just four grams and life imprisonment for eight grams. Both states reported a roughly 25% decline in overdose deaths over the past year.

West Virginia, with the nation’s lowest threshold—less than one gram—also reported a near‑20% drop in fentanyl‑related deaths within a year.

Legislative efforts at the federal level

In early 2025, Senator Kennedy and five colleagues introduced legislation to lower the quantity thresholds that trigger federal mandatory minimums for fentanyl trafficking. The bill has yet to gain significant traction in Congress.

The attorney concluded by emphasizing the human cost: more than 38,000 Americans died from fentanyl in 2025, a loss that would stretch across nearly 30 football fields of headstones. The prosecutor urged lawmakers to act swiftly, arguing that the crisis demands immediate legislative attention.
