Trump Administration Targets Foreign Influence in Activist Networks

President Donald Trump is taking a new approach by utilizing foreign influence laws, such as the Foreign Agents Registration Act (FARA), to investigate left-wing activist networks accused of benefiting from foreign support. FARA’s Evolving Role

FARA, which mandates disclosure of foreign affiliations, has seen increased enforcement since 2016. Legal experts note its potential as a tool in Trump’s campaign against foreign influence in activist networks. Hans von Spakovsky from Advancing American Freedom criticized the Biden administration’s prior use of FARA, suggesting it was politically motivated against Trump allies.

Historically, FARA prosecutions were rare, with only seven cases between 1966 and 2015. However, in 2018 alone, over 20 individuals faced charges. Under the Biden administration, figures like Paul Manafort and Michael Flynn were scrutinized for foreign ties, alongside Democrats like Rep. Henry Cuellar and Sen. Bob Menendez.

New Directives and Criticisms

The Trump administration’s national security strategy, outlined in NSPM-7, integrates FARA to address domestic terrorism and political violence. This directive has faced criticism from groups like the ACLU, concerned about potential impacts on free speech. However, Spakovsky argues it aligns with recommendations from a 2016 DOJ Inspector General report.

Legal experts like Jason Torchinsky caution against relying solely on FARA, noting its complexity and potential First Amendment defenses. Alternatives, such as IRS tools to revoke nonprofit status for illegal activities, may offer more straightforward enforcement options.

As the Trump administration continues to refine its approach, the role of FARA in addressing foreign influence remains a topic of debate among legal and political circles.
