Trump Administration Bars Canadian Whey, Molasses and Non‑Alcoholic Beer Effective Sept. 29

President Donald J. Trump announced a new trade action that will stop certain Canadian products from entering the United States starting at 12:01 a.m. Eastern Time on Sept. 29. The move targets whey products, molasses and non‑alcoholic beer listed in an annex to the proclamation.

Why the ban was imposed

According to the proclamation, Canada continues to apply tariff‑rate quota allocations that affect all types of U.S. cheese. The administration says those measures discriminate against American commerce and remain in place despite earlier U.S. actions aimed at resolving the dispute.

Legal authority and implementation

Trump cited authority under section 338 of the Tariff Act of 1930 and section 604 of the Trade Act of 1974 to exclude the goods. Executive agencies were ordered to enforce the ban, and the Commissioner of Customs and Border Protection was authorized to issue the necessary rules after consulting other officials.

Impact on existing shipments

Products already imported but not yet entered for consumption before the effective date will still be subject to the 50 percent ad valorem duty that was set in an earlier order. The ban follows Proclamation 11047, which imposed additional duties effective Aug. 19, and a brief three‑day suspension issued Aug. 18 after Canada signaled it would address the issue. That suspension lapsed when Canada did not follow through, according to the new proclamation.

What this means for consumers and businesses

U.S. importers of the affected Canadian goods will need to adjust their supply chains before the deadline. Consumers may see reduced availability of certain whey‑based products, molasses and non‑alcoholic beer that previously came from Canada. The administration emphasizes that the action protects American producers and restores a level playing field for U.S. dairy and related industries.

Response from trade groups

Industry groups representing U.S. dairy producers welcomed the measure, stating it corrects an ongoing imbalance caused by Canadian quota practices. Canadian trade officials have not yet issued a formal response, but the earlier suspension indicated a willingness to negotiate.

The Trump administration continues to monitor the situation and will work with Customs and Border Protection to ensure the ban is administered efficiently.
